By accessing or using this website, or by purchasing any product or service from us, you agree to be bound by these Terms of Service. 1. Overview of Services

SingMyMessage.com provides novelty products, entertainment services, and custom content, including but not limited to custom sound messages, personalized songs, humorous messages, user-requested gifts, and related digital or physical items. These items are intended for entertainment, personal expression, satire, lighthearted humor, celebration, and meaningful gift-giving.

Our products are not intended to be used maliciously. Any use of our products or services that causes harm, harassment, defamation, abuse, or violates applicable law is strictly prohibited.

2. Eligibility and Customer Representations

By using this website, you represent and warrant that:

You are at least 18 years of age.
You are legally competent to enter into binding agreements.
The information you provide to us, including payment and delivery details, is accurate and belongs to you.
You are not prohibited by court order or legal restriction from contacting, gifting, or delivering items to the recipient.
You have the right to submit any names, stories, lyrics, images, messages, or other personalization details you provide.

We reserve the right to cancel any order if we suspect a violation of these representations.

3. Custom Content and Technology Use

We use a variety of technologies and tools to fulfill custom orders, which may include automated, AI-assisted, or partially automated systems. By placing an order, you understand that the final product may be created, edited, modified, enhanced, or produced using such tools.

If you choose “Yes” when asked whether we may use your song anonymously for promotion, you grant us permission to retain and use the completed custom created content for promotional, editorial, portfolio, sample, or marketing purposes. This use will be anonymous unless we separately receive your permission to identify you. If you choose “No,” we will not use your completed song for promotional purposes, except as needed for internal records, legal compliance, quality control, or order support.

4. Ownership and Usage Rights

Ownership of completed digital products, such as songs, messages, lyrics, audio files, and video e-cards, transfers to you upon delivery for personal, non-commercial use. Redistribution, resale, public broadcast, commercial use, advertising use, or use in paid media without our written consent is not permitted.

We retain the right to reproduce, store, archive, or use copies of custom work for record keeping, legal compliance, quality control, promotional use, editorial use, portfolio display, or business purposes.

5. Delivery

We make every effort to deliver digital and physical products in a timely manner. Most custom song orders are delivered within one business day after order details and payment are received, unless otherwise stated or delayed by circumstances outside our control.

Delivery dates and times are estimates and are not guaranteed. We are not responsible for delays, losses, filtering, blocked messages, spam folder placement, incorrect email addresses, third-party delivery issues, payment processor delays, technical outages, or platform errors.

You agree to verify all order, delivery, and recipient information at the time of submission.

6. International Restrictions

We do not accept orders from, or ship to, the following countries or regions: North Korea, Iran, Syria, Cuba, Russia, Belarus, the Crimea, Donetsk, or Luhansk regions of Ukraine, or any location subject to U.S. export restrictions or sanctions.

Orders placed from restricted locations may be canceled and refunded.

7. Order Modifications, Cancellations, and Refunds

Because custom products are created using the information you provide, cancellations may not be available once production has begun. If an order cannot be completed or delivered due to a technical or internal issue on our part, we may issue a refund, provide a revised product, or offer another reasonable solution.

We reserve the right to refuse service to anyone, at any time, for any reason, including but not limited to violations of these Terms of Service or our content standards.

8. The Sing My Message® Guarantee

We want you to feel good about your gift. If something is wrong with your order, contact us promptly and we will review the issue. Depending on the situation, we may provide a correction, replacement, credit, refund, or other reasonable solution.

The Sing My Message® Guarantee does not cover dissatisfaction caused by incomplete, inaccurate, misleading, or unclear information provided by the customer, changes of mind after production, recipient reactions, or requests that fall outside the original order details.

9. Content Standards

You may not submit content that is illegal, abusive, hateful, threatening, harassing, defamatory, exploitative, sexually explicit involving minors, discriminatory, or intended to demean, intimidate, or harm another person or group.

We may refuse, modify, or cancel any order that we believe violates our standards, the rights of others, applicable law, or the spirit of our services.

10. Indemnification and Liability

You are solely responsible for the content you request and the outcome of sending, sharing, playing, or delivering that content to any third party. You agree to indemnify, defend, and hold harmless UORealms LLC, its owners, employees, contractors, affiliates, and service providers from any claims, lawsuits, damages, expenses, or liabilities arising out of:

Your use or misuse of our products or services.
Any offense, emotional distress, dispute, or other reaction caused to a recipient or third party.
Any content submitted by you or requested to be created by us.
Your breach of these Terms of Service.
Your violation of any law, third-party right, or agreement.

This indemnification applies even if we are alleged to be negligent or partially responsible for the resulting harm.

11. Limitation of Liability

Our total liability to you, under any legal theory, shall not exceed the amount you paid for the product or service in question. We are not liable for indirect, incidental, punitive, special, exemplary, or consequential damages, including but not limited to lost profits, emotional distress, reputational harm, lost opportunity, or recipient reactions.

12. Arbitration and Governing Law

All disputes, claims, or controversies arising from your use of our website or services shall be resolved exclusively through binding arbitration conducted under the rules of the American Arbitration Association (AAA). Arbitration may be conducted remotely or in the State of New Mexico, United States.

You agree to waive your right to trial by jury and any right to participate in a class action lawsuit. This agreement is governed by the laws of the State of New Mexico, without regard to its conflict of laws provisions.
